Newsworthiness can be used as a defense for public disclosure of private acts. In order to assess how newsworthy information is, courts consider all of the following except:
the social value of the facts published
the extent to which the person about whom private facts were revealed voluntarily assumed a position of public notoriety
the impact the information would have on all parties involved
the depth of the publication’s intrusion into ostensibly private affairs
